Calcutta HC orders switch of probe into Birbhum explosions to NIA

Calcutta Excessive Courtroom has ordered switch of investigation into explosions in Birbhum district to the NIA from the state CID holding that the central company has priority within the investigation of scheduled offence.

Vacating an earlier keep by a single bench of the HC within the NIA probe, a division bench comprising Justices Joymalya Bagchi and Bivas Pattanayak in an interim order directed the CID to cooperate with NIA and to switch all paperwork associated to its probe into the 2019 explosion in two residential homes in Birbhum if required.

“Investigation by the central company whose powers are a lot wider than the state company could be simpler and enure to the ends of justice,” the bench noticed in its order handed on April 18.

Noting that the central company has priority within the investigation of scheduled offences as laid down in Part 6 of NIA Act, the bench stated “A prima facie case for switch of investigation in favour of NIA has been made out.”

Among the many scheduled offences which may be investigated by NIA are these underneath the Explosive Substances Act.

The matter will likely be heard once more on Could 10, the courtroom directed.

The CID was investigating the explosions in a home at Sadaipur in August, 2019 and at one other home at Lokpur in September that 12 months in September.

The counsel for the state claimed that the probe has been satisfactorily carried out by the CID and stated that NIA had sought to switch the investigation after a lapse of 1 12 months.

The NIA advocate submitted that the investigation by the central company was stalled by a keep granted by the excessive courtroom and prayed that it’s vacated.

The bench famous that the NIA Act requires the state company to submit a report back to it upon registration of an FIR in respect of scheduled offence in order that the central company might take a call whether or not to analyze the case or not.

“It seems no such report was submitted by the state company to NIA,” the bench stated.

After the CID continued investigation for greater than a 12 months, NIA had suo muto exercised powers as per provisions of the NIA Act and transferred the investigations to itself.
